Introduction

This E-Sign Policy explains how Zoooom, Inc. ("Zoooom," "we," "us," or "our") uses electronic signatures and provides electronic communications. To the fullest extent permitted by law, Zoooom accepts electronic signatures as legally binding and equivalent to handwritten signatures.

Legal Authority

This Policy is established pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA), which state that contracts and signatures "may not be denied legal effect, validity, or enforceability solely because an electronic signature or electronic record was used in its formation."

Electronic Signature

Any electronic sound, symbol, or process attached to or logically associated with a record and executed or adopted by a person with the intent to sign the record.

Electronic Record

A record created, generated, sent, communicated, received, or stored by electronic means.

Communications

Any notice, disclosure, agreement, acknowledgment, form, consent, statement, policy, record, document, or other information we provide to you or that you provide to us.

5. Obtaining Paper Copies

Right to Paper Copies. You have the right to receive paper copies of any electronic Communication at any time.

How to Request

Fees. We may charge a reasonable fee for paper copies unless prohibited by law. Current fee: $5 per document.

6. Withdrawing Consent

You may withdraw consent at any time by:

Consequences of Withdrawal. Withdrawing consent may result in limited access to certain Services, delayed transaction processing, requirement for paper documentation, and possible service termination. Withdrawal becomes effective after reasonable time for processing.

8. Electronic Signature Methods

We may use various electronic signature methods including click-to-sign (buttons & checkboxes), typed name in text fields, digital signature via touch/stylus, biometric (facial/fingerprint), email confirmation, and SMS verification codes.

9. Legal Effect

Binding Nature. Electronic signatures and Communications are legally binding, enforceable in court, equivalent to paper documents, valid for all purposes, and admissible as evidence.

We protect electronic Communications through end-to-end encryption, secure servers and databases, access controls and authentication, comprehensive audit trails, and regular security assessments.

12. Transaction Verification

For certain transactions, we may require multi-factor authentication, identity verification, security questions, email confirmations, SMS verification, and biometric checks.

13. Errors and Modifications

If you believe an electronic Communication contains errors, contact us immediately, provide specific details of the error, and we will investigate promptly and document any corrections.

14. Scope Limitations

This Policy Does Not Apply To: certain legal notices requiring paper delivery by law, documents specifically excluded by the E-SIGN Act, Communications you specifically request in paper format, and court orders and certain legal proceedings.

15. Agreement Confirmation

By Using Our Services, You Confirm that you can access and read this Policy, that you have the required hardware and software, that you consent to electronic Communications, that you can receive and access electronic records, and that you agree to use electronic signatures.
